The Problem:

One of our goals was to bring up the Judicial System, including training County Court Clerks to manage and support Common Law courts. 

How are we to train them?

Facts & Assumptions:
  1. There are many types of law. A Venn Diagram might show one small circle in the center of a cluster of other circles around it.

    The center circle would be labeled as Common/Human Law. Preachers might argue that “Human” should be “God’s Law”).

    The Outside cluster might be labeled: Administrative, Agency, Family, Commercial Transactions, Contracts, Corporation, Criminal, International, Maritime, Tort, Wills & Probate. Then we might have one circle outside alone labeled Civil Procedure.

  2. Stare Decisis means “to stand by things decided” in Latin. Precedence is everything in our English law. Hundreds of years of Stare Decisis is our whole legal universe, our history.

  3. Prior to the U.S. Civil War, Common Law would have been one of the cluster circles, but after the corporations took over our Governments, it was no longer practiced here. As a result, there is very minimal manuals of it’s practices and systems.

  4. Law librarys are filled with rooms of case law books as references to back up precedence, as it is important to all areas of law.

  5. In our era Florida County Court Clerks are only required to have a High School diploma but should have some legal office experience.

  6. In our era County Court Clerks are heavily vested in sophisticated software preparing for cases and then recording closed cases and tracking all materials needed in each case. They also report cases to the printers of those casebooks mentioned in “D” above.

  7. Just because we are returning to Common Law all the other circles in “A” above will still be there. Only a few will get a little smaller in size.

  8. This problem is related to Proposal – Training Judicial Officers which suggests we retain former BAR attorneys because we will need them desperately.
The Plan:
  1. It is absurd for us Patriots to think the entire legal system will stop and begin turning in reverse just because of us. That system will just remove Common Law from the inner circle leaving just Human Law. Common will be a new part of the cluster. And the Preachers will still bitch.

  2. There is no training we can give County Court Clerks.

  3. Make a decision on Proposal – Training Judicial Officers.

Pros:
– Recognizes reality and our smallness in the world of time.
– Frees up 67 clerks to prepare us elsewhere for the onslaught coming.
